Seller Terms of Use

These Seller Terms of Use (“Terms”) govern purchases, shipping and fulfillment, online and live breaking activities, refunds, cancellations, claims, and disputes involving Magic City Collectibles (“Magic City,” “we,” “us,” or “our”). By placing an order, purchasing a product, participating in a break, or otherwise completing a transaction with Magic City, you acknowledge that you have read, understood, and agreed to these Terms.
1. General Terms
Magic City Collectibles sells sports cards, trading card games (“TCG”), collectibles, sealed products, singles, boxes, packs, and other related merchandise through its online sales channels and live-breaking activities.
All sales are subject to product availability. Product descriptions, images, quantities, configurations, and other information are provided in good faith. While we make reasonable efforts to ensure listings are accurate, minor variations in packaging, manufacturer design, or product appearance may occur.
Magic City reserves the right to correct typographical, pricing, inventory, or listing errors and to cancel or adjust an order affected by such an error.
2. Shipping and Fulfillment Expectations
2.1 Order Processing
Orders will generally be processed as soon as reasonably practicable after payment has been successfully received and verified.
Processing times may vary depending on product availability, order volume, holidays, live events, product releases, or other circumstances beyond Magic City's reasonable control.
Certain products, including pre-orders and break-related purchases, may have different fulfillment timelines. Any special fulfillment timeline communicated at the time of purchase will control.
2.2 Shipping
Orders will be shipped to the address provided by the customer at checkout. Customers are responsible for ensuring that their shipping information is accurate and complete.
Magic City is not responsible for delays, losses, or delivery issues caused by:
- Incorrect or incomplete shipping addresses;
- Customer-requested delivery changes;
- Carrier delays;
- Weather or natural disasters;
- Postal or carrier service interruptions;
- Customs or governmental delays; or
- Other circumstances outside Magic City's reasonable control.
Once an order has been transferred to the shipping carrier, delivery is subject to the carrier's policies and procedures.
2.3 Package Tracking
When applicable, customers will receive tracking information after the order has shipped.
Customers are responsible for monitoring tracking information and promptly reporting packages that appear to be lost, misdelivered, or otherwise experiencing a delivery issue.
2.4 Damaged Shipments
Customers should inspect packages promptly upon delivery.
If an order arrives damaged, customers should retain the original packaging, shipping materials, and damaged merchandise and contact Magic City as soon as possible. Photographs of the shipping box, packaging, shipping label, and damaged contents may be required to process a claim.
3. Online and Live Break Policies
Magic City Collectibles conducts both online and live sports card and TCG breaks. Because break products are opened and allocated during a live or recorded breaking process, special rules apply.
3.1 Break Purchases Are Final
All break spots are considered final sale once purchased.
Because a break spot represents a purchase of an opportunity to receive cards or collectibles from a particular product, team, player, division, random assignment, or other designated break format, customers may not cancel or return a break spot simply because the results are not what they expected.
There are no refunds for unfavorable break results, lack of hits, lack of a particular player or team, perceived value of cards received, or personal dissatisfaction with the outcome of a break.
3.2 Break Format
Each break will be conducted according to the format described at the time of purchase.
Depending on the break, a customer's purchase may correspond to:
- A specific team;
- A specific player;
- A division or conference;
- A random team or assignment;
- A random player;
- A designated number of spots;
- A specific product or configuration; or
- Another format clearly identified by Magic City.
Customers are responsible for reviewing the break format before purchasing.
3.3 Random Assignments
For breaks involving random team, player, or other assignments, assignments will be determined using the method disclosed by Magic City for that particular break.
Once a random assignment has been completed, the assignment is final unless Magic City determines that an administrative or technical error occurred.
3.4 Cards and Hits
Break results are determined by the contents of the product opened during the break.
Magic City does not guarantee that a participant will receive a card, autograph, memorabilia card, numbered card, parallel, short print, chase card, or other specific hit unless that item is expressly guaranteed in the break description.
The absence of a hit or specific card does not constitute an error and does not qualify for a refund.
3.5 Multi-Team or Multi-Player Cards
Cards featuring multiple teams, players, or other entities will be handled according to the rules announced for the applicable break.
If a special rule is not stated in advance, Magic City may determine the appropriate allocation method in a reasonable and consistent manner.
3.6 Live Breaks
Customers participating in live breaks acknowledge that breaks are conducted in real time and that cards are opened and revealed during the event.
Customers are responsible for monitoring the break and understanding the rules announced before or during the break.
If a customer is not present during the live break, the break may proceed without them. Failure to watch a live break does not invalidate the purchase or create a right to a refund.
3.7 Shipping Break Results
Cards and other items obtained through a break will be shipped according to Magic City's standard fulfillment procedures unless otherwise stated.
Magic City may consolidate multiple break results into a single shipment when appropriate.
4. Refund and Cancellation Policy
4.1 All Sales Final
All sales are final. Magic City Collectibles does not offer refunds, returns, or exchanges except in cases involving an error by Magic City.
This policy applies to both standard merchandise purchases and break purchases.
4.2 Errors Qualifying for Review
A refund, replacement, correction, or other appropriate resolution may be considered when Magic City determines that an error occurred, including situations such as:
- The wrong product was shipped;
- An item was missing from an order due to a fulfillment error;
- A customer was charged incorrectly due to a confirmed Magic City error;
- A break result was incorrectly allocated due to a confirmed administrative error; or
- Another material fulfillment error occurred that was directly attributable to Magic City.
The appropriate resolution may include a replacement, correction, store credit, refund, or other remedy determined by Magic City based on the circumstances.
4.3 No Refunds for Changed Mind or Market Value
Refunds will not be provided because:
- A customer changed their mind;
- A product's market value decreased;
- A customer believes they overpaid;
- A customer did not receive the card they hoped for;
- A break did not produce a desired hit;
- A customer no longer wants the item;
- A customer purchased the wrong break spot;
- A card or collectible is worth less than expected; or
- A customer is dissatisfied with the outcome of a properly conducted break.
4.4 Cancellation Requests
Once an order or break spot has been purchased, Magic City may begin processing the transaction immediately.
Cancellation requests are not guaranteed and may be denied once an order has entered fulfillment or a break has been scheduled, sold, or conducted.
5. Claims and Dispute Procedures
5.1 Contact Magic City First
Customers agree to contact Magic City Collectibles directly regarding any order issue before initiating a payment dispute, chargeback, or other third-party dispute.
This allows Magic City an opportunity to investigate and resolve legitimate issues efficiently.
5.2 Claims Deadline
Customers should report any issue with an order as soon as reasonably possible after receiving the shipment.
Claims involving damaged, missing, incorrect, or incomplete merchandise should generally be submitted within 7 calendar days of delivery.
Claims involving break allocations or break-related errors should be submitted promptly after the customer becomes aware of the alleged issue.
Magic City may request additional information, photographs, video, order information, tracking information, or other documentation necessary to investigate a claim.
5.3 Required Claim Information
A claim should include, when applicable:
- Customer name;
- Order number;
- Date of purchase;
- Description of the issue;
- Photographs or video of the product and packaging;
- Shipping information;
- Relevant break information; and
- Any other documentation reasonably requested by Magic City.
5.4 Investigation
Magic City will review submitted claims and determine whether an error occurred.
Magic City may review order records, inventory records, shipping records, break recordings, photographs, videos, transaction records, and other available information when investigating a dispute.
A customer's assertion that an error occurred does not automatically establish that an error occurred.
5.5 Payment Disputes and Chargebacks
Customers agree to first provide Magic City with a reasonable opportunity to resolve a legitimate transaction issue before filing a chargeback or payment dispute.
If a chargeback or payment dispute is filed, Magic City may provide the applicable payment processor with relevant transaction records, order information, shipping documentation, tracking information, break records, communications, and other evidence necessary to respond to the dispute.
Fraudulent or abusive claims, including knowingly false claims or repeated chargebacks for valid transactions, may result in the restriction or termination of the customer's ability to purchase from or participate in Magic City activities.
6. Product and Break Condition
Customers understand that collectible cards and sealed products may contain normal manufacturing imperfections, including but not limited to:
- Minor centering issues;
- Factory print lines;
- Minor surface imperfections;
- Minor corner or edge imperfections;
- Packaging imperfections; or
- Other manufacturing variations.
Such conditions do not automatically constitute a fulfillment error by Magic City.
Where applicable, manufacturer defects are the responsibility of the manufacturer and may need to be addressed directly with the manufacturer.
7. Fraud, Abuse, and Policy Violations
Magic City reserves the right to refuse or cancel transactions, restrict accounts, or prohibit participation in future sales or breaks when there is evidence of fraud, abuse, harassment, manipulation, repeated invalid claims, payment abuse, or other conduct that threatens the integrity of Magic City's operations or community.
Magic City may also take appropriate action when a customer attempts to circumvent these Terms through multiple accounts or other means.
8. Changes to These Terms
Magic City Collectibles reserves the right to update or modify these Terms from time to time.
Updated Terms may be posted through Magic City's applicable website, sales platform, or other customer-facing channel. Continued use of Magic City's services after updated Terms are posted constitutes acceptance of the revised Terms.
9. Customer Acknowledgment
By completing a purchase or participating in an online or live break through Magic City Collectibles, the customer acknowledges that they have reviewed and agreed to these Terms, including the shipping, fulfillment, break, refund, cancellation, claim, and dispute provisions.
Magic City Collectibles reserves the right to interpret and enforce these Terms in a reasonable and consistent manner.
